Terms, Conditions, Disclaimers & Limited Warranty
Undaunted Manufacturing NC LLC
Operating as Undaunted Manufacturing
IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE PURCHASING, INSTALLING, OR USING ANY PRODUCT.
These Terms, Conditions, Disclaimers & Limited Warranty (“Terms”) apply to products manufactured, distributed, or sold by Undaunted Manufacturing NC LLC, operating as Undaunted Manufacturing (referred to as “Undaunted Manufacturing,” “Company,” “we,” “us,” or “our”).
Undaunted Manufacturing develops, manufactures, and sells aftermarket performance components, replacement parts, accessories, and related products for chainsaws, outdoor power equipment, and other equipment or applications identified in individual product descriptions.
Products may include exhaust components, engine-related components, filtration systems, recoil components, cutting accessories, mounting hardware, and other mechanical or performance-related products. Certain products may alter equipment performance, operating characteristics, noise levels, temperatures, emissions, reliability, or safety.
THE PURCHASER, INSTALLER, OPERATOR, AND END USER ARE RESPONSIBLE FOR VERIFYING PRODUCT COMPATIBILITY, SUITABILITY, PROPER INSTALLATION, SAFE OPERATION, INSPECTION, MAINTENANCE, AND LAWFUL USE.
The installation and use of aftermarket components may involve inherent risks. Purchasers and end users assume responsibility for risks arising from their own installation, modification, operation, maintenance, or misuse of products, to the fullest extent permitted by applicable law.
Nothing in these Terms eliminates any legal obligation or liability that cannot lawfully be excluded or limited.
1. Product Compatibility & Manufacturer Affiliation
Undaunted Manufacturing products are independent aftermarket components intended for the equipment models, configurations, and applications identified in their respective product descriptions.
The purchaser and installer are responsible for verifying compatibility and suitability before installation or use.
Compatibility may depend on equipment model, production year, configuration, modifications, existing components, operating conditions, and other factors.
A product's listed compatibility does not guarantee suitability for every modified or nonstandard equipment configuration.
UNDAUNTED MANUFACTURING NC LLC IS AN INDEPENDENT AFTERMARKET MANUFACTURER. UNLESS EXPRESSLY STATED OTHERWISE, OUR PRODUCTS ARE NOT MANUFACTURED, APPROVED, AUTHORIZED, SPONSORED, OR ENDORSED BY STIHL, HUSQVARNA, ECHO, OR ANY OTHER ORIGINAL EQUIPMENT MANUFACTURER (OEM).
Manufacturer names, trademarks, model numbers, and other identifying information are used solely to describe intended product compatibility.
No affiliation, sponsorship, or endorsement is implied.
2. Assumption of Risk & Customer Responsibility
Aftermarket components, replacement parts, performance modifications, and equipment accessories may introduce or increase risks depending on their design, application, installation, and use.
Potential risks include, but are not limited to:
- Mechanical failure, component failure, or equipment damage.
- Changes in operating temperatures, noise levels, vibration, emissions, or performance.
- Unexpected equipment behavior or malfunction.
- Personal injury, serious bodily injury, or death.
- Damage to personal or third-party property.
- Equipment downtime, loss of use, or financial losses.
- Reduced equipment reliability or service life.
- Changes to OEM warranty coverage or regulatory compliance.
Not every risk applies to every product. Applicable risks depend on the product, equipment, and intended use.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PURCHASERS AND END USERS VOLUNTARILY ASSUME THE INHERENT AND REASONABLY FORESEEABLE RISKS ASSOCIATED WITH THEIR OWN INSTALLATION, MODIFICATION, OPERATION, INSPECTION, MAINTENANCE, AND USE OF OUR PRODUCTS.
Purchasers and end users are responsible for determining whether their equipment can be safely operated with the installed components.
Undaunted Manufacturing does not control independent customer decisions, installation practices, equipment modifications, operating conditions, or maintenance performed after delivery.
The purchaser is responsible for communicating applicable product instructions, warnings, and safety information to subsequent installers, operators, or end users.
Nothing in this section releases Undaunted Manufacturing from liability for its own conduct, product defects, or other responsibilities to the extent such liability cannot lawfully be excluded.
3. Installation, Operation & Maintenance
Proper installation, operation, inspection, and maintenance are essential to product safety and reliability.
Installation and maintenance requirements vary depending on the product and its intended application.
Where applicable, purchasers, installers, operators, and end users are responsible for:
- Verifying product compatibility before installation.
- Reviewing and following all supplied installation instructions and safety warnings.
- Using specified mounting hardware, fasteners, gaskets, seals, heat shields, threadlocker, or other required components.
- Following applicable torque specifications and assembly procedures.
- Performing required engine tuning, recalibration, or equipment adjustments.
- Retorquing fasteners after initial operation or heat cycles when specified.
- Periodically inspecting products, fasteners, mounting points, and surrounding equipment.
- Monitoring for abnormal temperatures, vibration, noise, wear, loosening, or other unsafe conditions.
- Discontinuing operation immediately if a product becomes loose, damaged, defective, or unsafe.
- Obtaining qualified installation or service assistance when appropriate.
- Maintaining the equipment in accordance with applicable manufacturer instructions and product-specific requirements.
Not all requirements apply to every product. Customers must follow the instructions applicable to the particular product and installation.
IMPROPER INSTALLATION, INCORRECT ASSEMBLY, FAILURE TO FOLLOW INSTRUCTIONS, INADEQUATE INSPECTION, OR CONTINUED OPERATION OF DAMAGED EQUIPMENT MAY RESULT IN COMPONENT FAILURE, EQUIPMENT DAMAGE, SERIOUS PERSONAL INJURY, OR DEATH.
To the fullest extent permitted by applicable law, Undaunted Manufacturing disclaims responsibility for damage or loss caused by improper installation, misuse, inadequate maintenance, unauthorized modifications, or failure to follow applicable instructions.
This disclaimer does not exclude responsibility for manufacturing defects or other liabilities that cannot legally be disclaimed.
4. Original Equipment Manufacturer Warranty
Installation or use of aftermarket components may affect warranty coverage provided by the original equipment manufacturer.
The effect on OEM warranty coverage depends on the nature of the modification, the cause of the claimed failure, applicable warranty terms, and governing law.
INSTALLING AN AFTERMARKET COMPONENT DOES NOT NECESSARILY VOID AN ENTIRE OEM WARRANTY.
However, an OEM may deny coverage for damage or failures properly attributable to an aftermarket component or modification, subject to applicable law.
Customers should consult the equipment manufacturer or an authorized dealer when concerned about existing warranty coverage.
Undaunted Manufacturing does not guarantee that installation or use of its products will preserve OEM warranty coverage.
To the fullest extent permitted by law, Undaunted Manufacturing is not responsible for OEM warranty denials attributable to customer-selected modifications or applications.
5. Legal, Emissions & Regulatory Compliance
Products must be purchased, installed, operated, and used in compliance with applicable federal, state, and local laws and regulations.
Depending on the product and application, relevant requirements may include:
- Emissions and environmental regulations.
- Exhaust noise restrictions.
- Spark arrestor requirements.
- Equipment safety standards.
- Workplace and occupational safety requirements.
- Equipment modification restrictions.
- Other applicable laws governing equipment operation or intended use.
Certain products may be intended for applications subject to additional legal restrictions.
Unless expressly stated in applicable product documentation, Undaunted Manufacturing makes no representation that a product is certified, approved, or compliant for a particular regulated application.
A spark arrestor screen or similar component does not, by itself, establish certification or approval of a complete exhaust system.
PRODUCTS MUST NOT BE INSTALLED OR USED IN VIOLATION OF APPLICABLE LAW.
Purchasers and end users are responsible for determining whether their intended installation and use are lawful.
To the fullest extent permitted by law, Undaunted Manufacturing disclaims liability for penalties, fines, or consequences arising from a customer's independent unlawful installation, modification, or use.
Nothing in these Terms transfers, eliminates, or limits any independent legal or regulatory obligations imposed on Undaunted Manufacturing NC LLC as a manufacturer, distributor, or seller.
6. Limited Warranty — Purchases on or After October 9, 2026
Undaunted Manufacturing NC LLC provides a 90-Day Limited Warranty against verified manufacturing defects in materials and workmanship for products purchased on or after October 9, 2026, unless a different written warranty is expressly provided for a particular product.
The warranty period begins on the original date of purchase.
Coverage applies to manufacturing defects arising under normal, intended use when the product has been properly installed, operated, and maintained.
Warranty Remedy
For an approved warranty claim, Undaunted Manufacturing NC LLC will, at its discretion, repair or replace the defective product or component without charge for the covered remedy.
If repair or replacement cannot be provided within a reasonable time or fails of its essential purpose, additional remedies may be available under applicable law.
Warranty Exclusions
This limited warranty does not cover damage, deterioration, or failures caused by:
- Improper installation, incorrect assembly, or failure to follow applicable instructions.
- Misuse, abuse, neglect, accidents, or improper operation.
- Unauthorized modifications or incompatible applications.
- Incorrectly installed, loose, missing, or improperly secured mounting hardware.
- Failure to follow applicable torque, threadlocker, inspection, or maintenance requirements.
- Failure to use required installation components.
- Improper engine tuning, calibration, or abnormal equipment operating conditions.
- Impact damage, corrosion, or exposure to conditions beyond the product's intended operating environment.
- Excessive heat or external conditions unrelated to a manufacturing defect.
- Normal wear and tear or cosmetic deterioration unrelated to manufacturing defects.
- Continued operation after a product or associated equipment becomes damaged or unsafe.
- Damage caused by third-party components or equipment conditions unrelated to a manufacturing defect in the covered product.
An excluded event does not automatically invalidate coverage for an unrelated, otherwise covered manufacturing defect.
THIS LIMITED WARRANTY COVERS VERIFIED MANUFACTURING DEFECTS ONLY. IT DOES NOT COVER DAMAGE TO ENGINES, EQUIPMENT, SURROUNDING COMPONENTS, INSTALLATION LABOR, EQUIPMENT DOWNTIME, OR OTHER CONSEQUENTIAL LOSSES, EXCEPT WHERE REQUIRED BY APPLICABLE LAW.
Installation and normal operation do not automatically void the warranty. Coverage is determined by the cause of the alleged defect or failure.
7. Grandfathered Lifetime Warranty — Purchases Before October 9, 2026
Products purchased before October 9, 2026, that were sold with Undaunted Manufacturing's original lifetime warranty retain the warranty coverage established at the time of purchase.
The original lifetime warranty covering manufacturing defects in materials and workmanship remains applicable to qualifying products.
Coverage is subject to the original warranty terms and applicable law.
Exclusions for misuse, neglect, improper installation, unauthorized modifications, normal wear, or inadequate maintenance apply only to the extent consistent with the original warranty and applicable law.
For approved claims, Undaunted Manufacturing NC LLC will provide the remedy required by the original warranty, which may include repair or replacement.
Where consistent with the original warranty and applicable law, the Company's standard remedy is one replacement per qualifying defective product.
THE INTRODUCTION OF THE 90-DAY LIMITED WARRANTY DOES NOT RETROACTIVELY TERMINATE, SHORTEN, OR REDUCE WARRANTY RIGHTS ESTABLISHED FOR QUALIFYING PURCHASES MADE BEFORE OCTOBER 9, 2026.
Any ambiguity regarding an earlier warranty will be evaluated under the warranty terms and applicable law governing the original purchase.
8. Warranty Claims, Inspection & Determination
Warranty claims must be submitted through Undaunted Manufacturing's designated customer support channels.
Customers should provide:
- Proof of purchase or other information sufficient to establish warranty eligibility.
- Product identification and approximate purchase date.
- A description of the alleged defect or failure.
- Clear photographs documenting the product's condition, when reasonably available.
Additional information may be requested when reasonably necessary to evaluate a claim, including installation details, maintenance information, or photographs of associated equipment.
Undaunted Manufacturing may request that a product be returned for inspection.
Customers should obtain return instructions before shipping products for warranty evaluation.
Return shipping arrangements and any applicable charges will be communicated during the claims process, consistent with applicable law and the warranty governing the purchase.
Warranty claims will be evaluated in good faith based on the applicable warranty terms, available documentation, inspection findings, and the cause of the alleged defect or failure.
The Company reserves the right to inspect products and investigate reported failures before making a coverage determination.
A claim will not be denied solely because a product has been installed, used as intended, or serviced, unless the circumstances establish an applicable exclusion or otherwise affect coverage under governing law.
For products covered by the 90-day limited warranty, repair or replacement does not restart the original warranty period unless required by applicable law.
9. Performance, Operating Characteristics & Safety
Undaunted Manufacturing products may affect equipment performance, mechanical operation, noise, temperatures, vibration, emissions, reliability, or other characteristics, depending on the product and application.
Published horsepower, torque, performance, or other testing figures reflect the conditions under which measurements were obtained.
Actual results may vary based on equipment configuration, condition, tuning, installation, operating environment, and other factors.
UNLESS EXPRESSLY PROVIDED IN A SPECIFIC WRITTEN PRODUCT WARRANTY, UNDAUNTED MANUFACTURING DOES NOT GUARANTEE PARTICULAR PERFORMANCE IMPROVEMENTS, INCREASED EQUIPMENT LONGEVITY, OR FREEDOM FROM MECHANICAL FAILURE.
Customers are responsible for following applicable equipment safety instructions and using appropriate personal protective equipment.
Products that increase exhaust noise or other operating noise may require additional hearing protection.
Products affecting mechanical performance, cutting equipment, engine operation, or other safety-sensitive systems must be installed and operated with particular attention to the applicable product instructions and equipment safety requirements.
No product should be used if its condition or installation presents an unsafe operating condition.
10. Limitation of Liability & Allocation of Responsibility
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDAUNTED MANUFACTURING NC LLC, ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES DISCLAIM LIABILITY FOR LOSSES, DAMAGES, INJURIES, OR EQUIPMENT FAILURES CAUSED BY IMPROPER INSTALLATION, MISUSE, NEGLECT, INADEQUATE MAINTENANCE, UNAUTHORIZED MODIFICATIONS, INCOMPATIBLE APPLICATIONS, OR UNLAWFUL USE OF ITS PRODUCTS.
Purchasers and end users accept responsibility for their own installation practices, equipment modifications, operating decisions, maintenance, and compliance with applicable laws.
Undaunted Manufacturing does not control how products are installed, operated, modified, maintained, or used after delivery.
To the fullest extent permitted by law, the purchaser and end user agree not to hold Undaunted Manufacturing responsible for losses attributable to their own negligence, misuse, improper installation, unauthorized modifications, or failure to follow applicable instructions.
To the fullest extent permitted by applicable law, Undaunted Manufacturing excludes liability for indirect, incidental, special, or consequential economic damages, including:
- Lost profits or revenue.
- Business interruption.
- Equipment downtime.
- Loss of use.
- Lost productivity.
- Other consequential economic losses.
For claims arising solely from breach of an applicable express limited warranty, the Company's obligations are limited to the remedies provided by that warranty, to the extent permitted by law.
These provisions are intended to allocate responsibility for risks and losses attributable to customer-controlled activities. They do not constitute a release of claims that cannot lawfully be waived.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEFECTIVE PRODUCTS, PERSONAL INJURY, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, VIOLATIONS OF LAW, OR OTHER MATTERS TO THE EXTENT SUCH LIABILITY CANNOT LEGALLY BE EXCLUDED OR LIMITED.
Nothing in these Terms eliminates nonwaivable product-liability obligations, statutory consumer protections, or other legal responsibilities imposed on Undaunted Manufacturing NC LLC.
11. Implied Warranties & Consumer Rights
For products covered by the 90-day limited warranty, the duration of any implied warranties, including the implied warranty of merchantability or fitness for a particular purpose, is limited to 90 days from the original purchase date, to the extent permitted by applicable law.
For products purchased before October 9, 2026, applicable implied warranty rights remain subject to the original warranty terms and governing law.
Some states do not allow limitations on the duration of implied warranties or exclusions of incidental or consequential damages. Accordingly, certain limitations may not apply to every purchaser.
This warranty provides specific legal rights. Purchasers may also have additional rights that vary by state.
Nothing in these Terms eliminates or restricts consumer rights or remedies that cannot legally be waived.
12. Dealers, Distributors, Resellers & Product Transfers
Dealers, distributors, resellers, and other commercial purchasers are responsible for accurately communicating applicable compatibility information, installation requirements, product warnings, and warranty terms to their customers.
No dealer, distributor, reseller, or other third party is authorized to modify, expand, or create warranty obligations on behalf of Undaunted Manufacturing NC LLC without express written authorization.
Resale, transfer, or third-party installation does not constitute Company approval of a particular application, installation method, or operating condition.
Warranty eligibility and transferability are governed by the warranty applicable to the original purchase and governing law.
Commercial resale arrangements may be subject to separate written agreements.
Nothing in this section limits rights that cannot lawfully be restricted.
13. Product Information, Specifications & Design Changes
Undaunted Manufacturing makes reasonable efforts to provide accurate product descriptions, specifications, compatibility information, installation instructions, and safety disclosures.
Product information may be revised to reflect design improvements, manufacturing changes, updated compatibility findings, or corrections.
The Company reserves the right to modify product designs, materials, specifications, packaging, and published information without prior notice, subject to existing contractual obligations and applicable law.
Customers are responsible for reviewing the applicable product information and confirming compatibility before installation.
Minor design or appearance changes do not necessarily indicate a defect, provided the product otherwise conforms to applicable contractual requirements and express warranties.
Changes to product information do not retroactively eliminate warranty rights or other obligations established at the time of purchase.
14. Product-Specific Instructions & Disclosures
Certain products may be accompanied by additional installation instructions, compatibility restrictions, maintenance requirements, safety warnings, or regulatory disclosures.
These may be provided through product listings, packaging, instruction cards, manuals, labels, or other written documentation.
Customers are responsible for reviewing and following the instructions applicable to their particular product.
Where a product-specific instruction imposes a more particular safety or installation requirement, that instruction supplements these general Terms.
Product-specific disclosures do not override nonwaivable legal rights or reduce express warranty coverage established at the time of purchase unless legally permissible and expressly agreed upon.
If an applicable product-specific written warranty expressly provides different coverage, that warranty governs the covered product to the extent permitted by law.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.
To the extent legally permissible, disputes arising from the purchase or use of Undaunted Manufacturing products shall be brought before a court of competent jurisdiction in North Carolina.
Nothing in this provision overrides mandatory consumer-protection laws, jurisdictional requirements, or other nonwaivable legal rights.
16. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be limited or severed to the extent necessary and legally permissible.
The remaining provisions shall continue in effect to the fullest extent permitted by applicable law.
17. Acceptance of Terms
By completing a purchase after these Terms have been made available for review, the purchaser acknowledges the applicable product information, warnings, warranty provisions, and responsibilities described herein.
Purchasers, installers, operators, and end users are responsible for reviewing applicable product instructions, safety requirements, and legal obligations before installation or use.
The enforceability of these Terms, including any limitations of liability or allocation of responsibility, remains subject to applicable contract and consumer-protection law.
Undaunted Manufacturing NC LLC reserves the right to revise these Terms prospectively.
Revisions will not retroactively reduce express warranty rights or other legal rights established under earlier purchases.
